Learned counsel for respondents 1 and 2 submits that the Vacation Bench of this Court, by an interim order dated 29th May 2025, had directed the respondents not to take a final decision with regard to grant of contract on the basis that the objection preferred by the petitioner has not been decided. 2.

Learned counsel for respondents 1 and 2 submits that the objection preferred by the petitioner has already been decided on 16th May 2025. However, the petitioner did not bring the aforesaid fact to the notice of this Court and on

905-WP.6741.2025.doc misrepresentation of fact has obtained the ex-parte interim order.

In view of the aforesaid submission, we are not inclined to continue the ad-interim order dated 29th May 2025. The same is hereby vacated.

Learned counsel for the petitioner shall be at liberty to amend the petition to challenge the order dated 16th May 2025 rejecting its objection, if so advised.

Learned counsel for the petitioner undertakes to tender draft amendment by tomorrow.

In the meanwhile, it is provided that any action taken by the respondents to award the contract in question shall be subject to outcome of the petition.
