Learned Counsel for the petitioner contends that she was appointed on the post of Assistant Teacher on 12.11.1992. He contends that prior to his appointment, she was holding necessary qualification of B.A., B.Ed. He then contends that she was promoted to the post of Head Mistress vide order dated 31.05.2024 and is holding the said post since 01.06.2024. He contends that in view of subsequent circular dated 28.01.2025, she is now sought to be reverted to the post
912-wp-6754-2025 of Assistant Teacher. The learned Counsel states that the petitioner is due for superannuation on 31.12.2025. The contention is that persons holding qualification of D.Ed. are sought to be placed above the petitioner in view of circular dated 28.01.2025. In view of the circular dated 28.01.2025, respondent no.5 has issued a show cause notice dated 11.05.2025 calling upon the petitioner, as to why she should not be reverted back to the post of Assistant Teacher. Since, the petitioner was holding the requisite qualification on the date of her initial appointment and she is duly promoted to the post of Head Mistress, although the hearing pursuant to the notice may continue, status quo be maintained with respect to employment of the petitioner on the post of Head Mistress till the returnable date.
