After arguing the petition for some time, the learned Advocate for the petitioner, on instructions, seeks permission to withdraw the petition with liberty to adopt the statutory remedy of Appeal.

The petition is, therefore, disposed of as withdrawn with liberty to approach the CJIT, Mumbai. It is made clear that the time spent in prosecuting the present petition shall be excluded while considering the limitation for filing the statutory appeal,

16-WP-6777-25.doc and since this Court, by order dated 30th May, 2025, protected the petitioner and the said protection was in force, the said protection shall continue till 11th May, 2026. 3.

However, it is made clear that continuation of the adinterim relief shall not be construed as an expression on merits and the statutory tribunal shall independently decide the application for waiver of pre-deposit on its own merits 4.

The petition stands disposed of.

While considering the application for waiver, the Appellate Tribunal shall take into consideration the deposit of Rs. 25 Lakhs already made by the petitioner.
