Heard learned Senior Counsel for the Petitioners, learned AGP for the Respondent-State and learned Counsel for Respondent Nos.2 and 3. 2.

We are not referring to the facts in detail as the same may prejudice the Petitioners. Suffice it to observe that the Petitioners were debarred by the Maharashtra State Board of Secondary and Higher Secondary Education vide its order dated 16th May 2025 and their entire performance of February/March 2025 examination was cancelled on the allegation which forms the subject matter of the cancellation of the examination. Out of 91 Petitioners, 80 Petitioners submitted applications to appear for the MMP

2 910-WP 6792-25.doc supplementary examination conducted by the Board in July 2025. Out of 80 Petitioners, 71 Petitioners appeared for Mathematics Examination and some of the Petitioners appeared for other subjects of HSC (Science) supplementary examination.

In the peculiar facts and circumstances of the case and after hearing learned Counsel for the parties, the following order will meet the ends of justice. Hence, the order:

ORDER

i.

The Board will issue a fresh mark sheet for supplementary examination conducted in July 2025 to the Petitioners who appeared for the supplementary examination without showing any stigmatic remark.

ii.

The remaining Petitioners shall be at liberty to appear in February/March 2026 as fresh candidates.

It is made clear that this order is passed in view of the peculiar facts and circumstances of the present case.
