Mr. Kakade, learned Additional Government Pleader waives notice for the Respondent Nos.2 and 3 and seeks time to take instructions and file a reply.

Mr. Patil, learned counsel appearing for the Petitioner submits that the Petitioner has obtained 166 total marks but her name does not appear in the Provisional Selection List of the selected candidates. He submits that the last candidate in the Provisional Selection List has obtained 148 total marks, which are less than the marks that the Petitioner has obtained. 4.

We have perused the Provisional Selection List as well as the General Merit List, which indicate the marks of the Petitioner to be more than those of the last candidate in the Selection List. The Petitioner has secured higher marks than the last candidate shown in the Provisional Selection List. 5.

The Petitioner made a representation by an e-mail dated 9th May 2025 to the Respondent No.1-Maharashtra Public Service Commission, but he has not received any reply to the same. The Petitioner has also personally visited the office of the Respondent No.1 and has once again made a representation on 30th May 2025. No reply is received from the Respondent No.1.

In these circumstances and by way of an ad-interim relief, if the final appointment orders are issued, one post be kept vacant for the Petitioner to be appointed on the said post, if she succeeds in the present Petition.
