Heard Mr. Desai, learned counsel appearing for the petitioners and Mr. Kalel, Mr. Mali and Mr. Naik, learned AGPs for the respondent - State in respective petitions.

As the issues involved in all these Writ Petitions are identical, these petitions are taken up for hearing together.

Mr. Desai, learned counsel appearing for the petitioners, has confined his relief to the alternate prayer of directing the authorities to decide the petitioners' representation afresh. It is his submission that certain points, which are mentioned in the representation are not taken into consideration. To substantiate the said contention, he points out the contentions raised on page 250 and 251 in the representation dated 4th December 2022, annexed to Writ Petition No. 6974 of 2025. The relevant portion reads as under :- "
मौजेतेरणीयेथीलज्याजमीनीवरतीआमचीउपजिविकावर्षानुवर्षेचालायचीत्या सुपिकजमीनीआंम्हीविनातक्रारप्रयायीजमीनमागणीनकरता१००% मोबदला रक्कमस्वि कारूनताबादिलेलाआहे.
निवाडयाप्रमाणेमिळालेल्यारक्कमेमध्ये प्रकल्पग्रस्तअन्यठिकाणीजमीनखरेदीघेवूनस्वतःचेपुनर्वसनकरूनघेवूशकत नाहीम्हणूनत्यालासहकार्यव्हावेहाचउद्देशठेवून१९७६पूर्वीपासूनआपलेकडील शासननिर्णयाप्रमाणेजेप्रकल्पग्रस्त१००% रक्कमउचलकरतातत्यांनापुर्नवसन अनुदानदेयआहे.
वत्याप्रमाणेसंपूर्णमहाराष्टराजामध्येपुनर्वसनअनुदानवाटप 2 of
केलेलेआहे.

उपजिल्हाधिकारी(भूसंपदन) सोकोल्हापूरयांनीता. आजरा, जि.
कोल्हापूर येथील उचंगी ल.पा.
तालावामध्ये क्रं. भूसं-६/ स्वेच्छा - उचंगी/एसआर/४७/९९अ, ब, क, ड/कावि-९२, दिनाक१५/०४/ २०१७रोजीच्या निवाडयाद्वारेमौजे उचंगी, मौजे जेऊर, मौजे चितळे, या गावातील बाधित प्रकल्पग्रस्तांनास्वेच्छापुनर्वसनअनुदानवाटपकेलेलेआहे. ता. आजरायेथील आंबेओहळप्रकल्पातीलआर्दाळकरपेवाडी, उत्तूरयागावातीलप्रकल्पग्रस्तांना स्वेच्छापुनर्वसनअंतिमनिवाडादिनांक१७/११/ २०१४प्रमाणेस्वेच्छापुनर्वसन अनुदानवाटपकेलेलेआहे.
तसेचकोल्हापूरजिल्हातीलता.
भुदरगडयेथील नागणवाडील.पा.
तलावातीलमौजेबारवे, मौजेदिंडेवाडी, मौजेमुरकुटे, येथील प्रकल्प्प्रतांनादेखीलदिनांक१८/०३/ २०१६चेअंतिमनिवाडयाप्रमाणेपुनर्वसन अनुदानदेणेतआलेलेआहे.
तसेचमौजेतळेरे, ता. कणकवली, जि.
सिंधुदुर्गयेथील ल.पा.
तलावतळेरेमधीलबाधितप्रकल्पग्रस्तांनादेखीलडेस्कर२/उपजि/भूसं/ जिम/ स्वेपुअनि / उपजिल्हाधिकारी(भूसंपादन) जिल्हामुख्यालयसिंदुदुर्गयाअंतिम निवाडयादवारेस्वेच्छापुनर्वसनअनुदानवाटपकरतआहेत. सदरपुनर्वसन अधिनियमानुसारयापुर्वीदेखीलसंपूर्णमहाराष्टामध्येपुनर्वसनअनुदानवाटपकेलेले आहे."

The above contention has not been taken into consideration by the Deputy Collector. Accordingly, the impugned order dated 2nd February 2024 passed by the Deputy Collector, Rehabilitation, Kolhapur is quashed and set aside and the said representation dated 4th December 2023 by the petitioners is remanded back to the Deputy Collector (Rehabilitation), Kolhapur for reconsideration.

The impugned order has been set aside only on the ground that all the contentions raised in the subject representation are not considered. The Deputy Collector, Rehabilitation, Kolhapur shall decide the said representation on or before 30th June 2026. It is specifically clarified that all the contentions are expressly kept open.

The Writ Petitions are disposed of in the above terms with no order as to costs.
