We have considered the submissions of the learned advocate for the Petitioners and the learned AGP on behalf of respondent Nos.1 to
3. Respondent Nos.4 and 5 are formal parties. 2.
There is no dispute that the Petitioners appointments have been granted with an approval and they are in employment. It is beyond debate that the Shalarth Pranali has been introduced to ensure payment of
( 2 ) 943 wp 7223.25 salaries to the teaching and non-teaching employees by directly depositing the same in their salary accounts. It is also settled by this Court in the case of Pramod Prabhakar Pokhale V/s. State of Maharashtra; 2019 (3) Bom.C.R. 278, that unless there is a fraud which is discovered after a detailed inquiry, the approval cannot be cancelled or revoked. 3.
In view of the above, both these Petitions are partly allowed. Respondent No.2 shall verify that the approval is granted and once it is noticed that the approval is intact, it shall proceed to grant the Shalarth ID to the Petitioners within a period of 21 days from today. Thereafter, the Petitioners would be entitled for payment of salary through the Shalarth Pranali.
