It is the contention of the petitioner that the entire outstanding has been paid by them. However, this contention is seriously disputed by learned counsel for the respondent No.3-Bank. We have not returned any finding on this submission of learned counsel for the petitioner. Suffice it to observe that according to the petitioner a substantial sum of money has been paid to the bank.

Heard learned counsel for the petitioner. Perused the averments made in the petition. Learned counsel for the respondent-bank submitted that they have filed MA(D) No. 555/2025 before DRT, Pune for modification of RC No. 103/2024.

We accordingly direct RC No. 103/2024 which is application filed by the petitioner at Exhibit 6 and MA(D) No. 555/2025 before DRT, Pune to Amk 1/2

901-wp 7231-25.doc be disposed of within a period of six weeks from the date of this order produced on record. Learned counsel for the petitioner as well as learned counsel for the respondent-bank submit that they will co-operate with the hearing before the DRT and will not ask for adjournment. 4.

All the rights and contentions of the parties are kept open. 5.

We are not observing anything on the merits of the case. 6.

The writ petition is disposed of.
