The grievance of these Petitioners is that previously they have already worked in difficult areas for periods ranging from 5 to 11 years. As per the Government policy, they were shifted out to the plain area and they have been working for periods ranging from 3 to 7 years in plain areas. Now again their names are proposed for transfer to tribal / difficult areas, when there are several such candidates in the list of 534 teachers, who have never ever worked in tribal / difficult areas. 2.
The learned advocate Shri Patil representing Respondent Nos.3 & 4 submits that the representation of these Petitioners dated 09.06.2025, has been forwarded to Respondent No.1 for necessary action.
( 2 ) 957 wp 7248.25 In so far as the teacher transfer management system is concerned, the Zilla Parishad has no role to play as it does not involve human intervention. 3.
The learned AGP submits that if notice is issued in this matter, he would take instructions.

Issue notice to the Respondents, returnable on 03.07.2025. The learned AGP waives service of notice on behalf of Respondent Nos.1 &
2. Shri Patil waives service of notice on behalf of Respondent Nos.3 & 4. 5.
We expect the State Government to apply its mind to the request of the Petitioners that they should not be repeatedly sent to the tribal / difficult areas. If there are such eligible teachers, save and except female teachers and those male teachers who have not completed 53 years, who have never worked in the difficult areas, they be considered for transfer to the tribal / difficult areas. Obviously, the Government would not issue transfer orders to these Petitioners without the leave of this Court. If the State Government desires any modification of this order, it is at liberty to circulate this matter.
