This is yet one more case wherein the Deputy Director of Education, Pune Region, Pune has flouted the dictum of this Court set out in the judgment dated 23rd October, 2024 delivered in Writ Petition No.2492 of 2024 (Nishant Namdeorao Gatkal and Another versus The State of Maharashtra and Others).

Several judgments delivered at the Aurangabad Bench have been referred to in the aforesaid judgment, in paragraph no. 2. This Court 1/3
has, therefore, taken the view that employees who have settled in employment for a long time should not be disturbed on the basis of complaints filed by strangers. Hence, the State of Maharashtra issued a Circular dated 18th February, 2025. Yet, the Deputy Director of Education, Pune has ignored, not only the judgments of this Court, but also defied the Circular dated 18th February, 2025.

We could have initiated action against the said Authority. However, the learned AGP prays that henceforth the said Officer will not commit any such act in the future.

After this matter was heard yesterday for quite some time, the learned Advocate for Respondent No.6 had sought a pass over to take instructions. Today, he submits that Respondent No.6 will withdraw his complaint lodged with the Deputy Director of Education and the Hon'ble Minister of Education, School Education Department. He desires to pursue a remedy under Section 41A of the Maharashtra Public Trust Act, 1950 before the Office of the Joint Charity Commissioner, where the change report inquiries are pending and his grievances are also being voiced before the said Authority.

In view of the above, the statement of Respondent No.6 is recorded. The impugned inquiries initiated by Respondent No. 2 and the Hon'ble Minister of Education etc., shall stand closed. 6.
With the above observations and directions, this Writ Petition is disposed off.
