In this writ petition, the petitioner has assailed the validity of the order dated 2nd April 2025 passed by the Special Inspector General of Police (Headquarters) of Prison and Correctional Services, by which the technical bid submitted by the petitioner has been rejected on the ground that the samples of Cotton Seed Oil and Vegetable Ghee submitted by the petitioner are of sub-standard quality.

Admittedly, during the pendency of the instant writ petition, the tender dated 14th February 2025 has been cancelled on 26th May 2025 and thereafter, fresh tenders have been invited.

It is pertinent to note that the petitioner has participated in the subsequent tender. Therefore, the challenge to the order dated 2nd April 2025, by which the technical bid of the petitioner has been rejected, has been rendered academic. The petitioner also cannot now challenge the cancellation of the earlier tender as he has subsequently participated in the fresh tenders. The conduct of the petitioner, therefore, dis-entitles it to any discretionary relief in exercise of power under Article 226 of the Constitution of India.

In the result, the writ petition fails and it is hereby dismissed.
