Learned counsel appears for Respondent Nos.1 and 2. On 10 February 2026 when the Writ Petition had come up, after considering the order dated 11 January 2024 passed in Writ Petition No.4674 of 2023 wherein the Petitioner had sought for the dispensation of the NOC from the father-in-law and mother-in-law of the Petitioner for compassionate appointment, this Court noting the age of father-in-law of the Petitioner which was 67 years and age of mother-in-law which was 56 years held that under the policy of compassionate appointment, they will not be eligible to receive any employment. In view thereof, insistence of NOC held to be not justifiable.

In the present case the Petitioner has sought dispensation of NOC from grandmother of the present Petitioner who is aged 78 years. We had considered it appropriate to dispense with such NOC but subject to hearing the Respondent Nos.1 and 2. Further, we had also considered that the Petitioner had made a representation on 7 November 2024 to Respondent Nos.1 and 2 which had not been considered till date. 3.

The learned counsel for Respondent Nos.1 and 2 states that the representation of the Petitioner dated 7 November 2024 will be considered by the Respondent Nos.1 and 2. The statement is accepted. 4.

In view of the above statement and by dispensing with the NOC from grandmother of the Petitioner, we direct the Respondent Nos.1 and 2 to consdier the representation of the Petitioner dated 7 November 2024 (Exhibit-D to the Petition) along with the supporting documents within a period of four weeks from the submission of the supporting documents along with the representation and which shall be submitted by the Petitioner within a period of one week from the date of uploading of this order.

The Writ Petition is accordingly disposed of. No order as to costs. 6.
