The impugned order dated 26th July, 2024 has been passed by the Education Officer (Secondary), Zilla Parishad, Pune. The only reason for refusing approval to the transfer of Petitioner Nos. 2 to 6 from the unaided establishment to the 20% aided establishment is that there are certain discrepancies. A cryptic order has been passed without mentioning which are those discrepancies. The impugned order, in the manner in which it is passed, cannot be sustained.

In view of the above, this Writ Petition is partly allowed. 1/2

The impugned order dated 26th July, 2024 stands quashed and set aside. The proposal of these Petitioners are restored to the file of Respondent No.2. Within 15 days from today, Respondent No.2 would communicate to the Management as to what are the discrepancies/ deficiencies. The Management shall remove those discrepancies, within two weeks thereafter and submit a revised proposal. Thereafter, by following the due procedure, Respondent No.2 would deal with the revised proposal and pass a reasoned order, within 45 days. 4.
