At the outset, learned Counsel appearing for the Respondent states that there is an alternate rememdy of filing Revision or Appeal under Section 42 of the Presidency Small Cause Courts Act, 1882 2.

In view of the said objection, Mr. Chaurasia, learned Counsel appearing for the Applicant seeks withdrawal of the Writ Petition with liberty to file appropriate proceedings. Accordingly, the Writ Petition is allowed to be withdrawn with liberty as sought.

Interim order dated 15th June, 2025 passed in this Writ Petition by a learned Single Judge shall remain in operation till 17th November 2025. Resultantly, the learned Executing Court is requested to defer the proceedings in Execution Application No. 299 of 2023 beyond 17th November 2025. 4.

It is clarified that this Court has not considered the merits and contentions on the merits of both the parties are expressly kept open.
