Petitioner has alternate efficacious remedy of filing appeal to challenge the order passed by the Assistant Charity Commissioner.

Learned Advocate for the Petitioner submits that the order passed by the Assistant Charity Commissioner is without jurisdiction, therefore, the Writ Petition is maintainable. 3.

We do not agree, even this ground can be taken up in appeal.

Faced with this situation, learned Advocate for the Petitioner, on instructions, seeks permission to withdraw the Writ Petition with liberty to avail alternate efficacious remedy of filing appropriate legal proceedings.

Permission is granted.

Writ Petition is disposed of as withdrawn with the liberty as prayed for.
