By this Writ Petition, the petitioner is challenging the order dated 21.06.2024 passed by the respondent No.2/Scrutiny Committee by which the caste claim of the petitioner of belonging to 'Rajput Bhamata' Vimukta Jati (A) has been invalidated.

Learned counsel for the petitioner submits that after passing of impugned order, the petitioner traced out the old document in the nature of revenue record showing certain entries in his favour and further submits that petitioner will substantiate her claim by relying on the said document which is oldest and have probative value. 4.
Learned AGP would submit that the Scrutiny Committee has rightly rejected the caste claim of the petitioner since, the petitioner
2 959.doc failed to substantiate the caste claim by placing on record the relevant old documents. Since, the documents which the petitioner is placing reliance were not placed before the Scrutiny Committee, the Scrutiny Committee had no occasion to consider the genuineness of the said documents.

He would further submit that it is only Scrutiny Committee which can ascertain the genuineness of these documents, we thus, find that the matter needs to be remanded back to the Scrutiny Committee, so as to find out the genuineness of the documents which are placed on record by the petitioner for the first time before this Court vide Exh.G (Page No.89) and Exh.H (Page No.90) of the Writ Petition. 6.
In that view of the matter, we are inclined to allow the Writ Petition partly by setting aside the impugned order and remanding the matter back to the Scrutiny Committee. Hence, we pass the following order :
ORDER
i) The Writ Petition is partly allowed.
ii) The impugned order dated 21.06.2024 passed by the respondent No.2/District Caste Certificate Scrutiny Committee, Jalna is hereby quashed and set-aside.
iii) The matter is remitted back to the Scrutiny Committee for ascertaining the genuineness of the so called documents annexed at page Nos.89 and
3 959.doc 90 i.e. Exh.G and Exh.H to the Writ Petition. iv) The Respondent No.2/Tribe Committee is directed to decide the caste claim on its own merits and in accordance with law.
