Heard Mr. Totala, learned advocate appearing for petitioner.

The petitioner seeks to challenge order passed by Micro and Small Enterprises Facilitation Council, Chhatrapati Sambhajinagar in Case No. ROABAD/MSEFC/AWARD/2025/118 dated 13.06.2025 under Section 15, 16 and 17 of Micro Small and Medium Enterprises Act.

Mr. Totala submits that exparte award is passed by Council against petitioner in respect of services which are beyond scope of jurisdiction of Council. In support of his contentions, he relies upon observations of Division Bench of this Court in case of Sterling and Wilson Vs. Union of India and Others, reported in AIR 2017 Bombay 242.

In that view of matter, keeping the point as to maintainability of writ petition open, issue notice to respondents, returnable on 31.07.2025.

In case a coercive step is taken against the petitioner, he shall be at liberty to move to this Court before returnable date. 6.

Petitioner shall be at liberty to serve respondents by private mode in addition to regular mode of service and file affidavit of service by returnable date.
