Learned counsel for the petitioners, on instructions, seeks leave to withdraw the petition with liberty to reserve the petitioners' right under Section 105 of Code of Civil Procedure, 1908 to challenge the impugned order in the event the final decree is adverse to the petitioners. He however submits that since this Court has earlier expedited the hearing of the suit the trial Court be directed that the suit be disposed of as expeditiously as possible as directed by this Court vide order 1/2

Leave granted to withdraw the writ petition with liberty to challenge the impugned order in view of Section 105 of Code of Civil Procedure, 1908 in an appeal if the final decree is adverse to the petitioners.

In view of the earlier directions issued by this Court on 25th April 2015 and 7th July 2023, I am sure that the trial Court shall consider expeditious hearing of the suit and not grant unnecessary adjournment.

Writ petition is disposed of as withdrawn subject to the aforesaid liberty to the petitioners.
5.
All rival contentions of the parties on merit in the suit are kept open.
