By this Petition preferred by the Navi Mumbai Municipal Corporation ('NMMC'), the Petitioner seeks extension of time of twelve months to comply with the Judgment and Order dated 22nd December 2023 passed by this Court (Coram: Devendra Kumar Upadhyaya, CJ & Arif S. Doctor, J. ) in Public Interest Litigation No.123 of 2016.

Having heard learned counsel appearing for the respective parties, we find that clause (b) of paragraph 49 of the said Judgment 1/3
and Order has been complied with by the NMMC, i.e., the Petitioner. It also appears that the Petitioner has forwarded its proposal to the State Government and the said proposal has been received by the State Government on 13th May 2025 and has been forwarded to the Director of Town Planning, Pune.

We are informed by Mr. Samant, learned Additional Government Pleader, that the Director of Town Planning has called for a report from the concerned Authorities and thereafter, the Director of Town Planning will forward his Report under Section 37(2) of the Maharashtra Regional Town Planning Act, 1966. Mr. Samant, learned Additional Government Pleader thus, seeks four months time to complete the entire exercise. Time of four months is accordingly granted.

We hope and trust that the directions given in the Judgment and Order dated 22nd December 2023 passed in Public Interest Litigation No.123 of 2016 will be complied with within the said period.

Petition stands disposed of in the aforesaid terms. 2/3
