This writ petition is filed to challenge the order rejecting the application to appoint the Court Commissioner. This application is rejected at the pre-trial stage. Hence, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file appropriate application at the time of the trial. 2.

Leave granted. Petitioner is at liberty to file appropriate application for the appointment of a Court Commissioner at the time of trial as permissible in law. If such application is made, the same shall be decided on its own merits, uninfluenced by the impugned order.

All rival contentions of the parties on merits are kept open. 4.

Writ Petition is disposed of as withdrawn with liberty as recorded above.
