We have considered the dates and sequence of events. It is obvious that Respondent No. 3 will have to verify the entire record in the light of the Petitioner's contention that he was appointed prior to 31.10.2005, when the institution was receiving 100% salary grants and the post on which the Petitioner was appointed was also on a 100% salary grants. Only after verifying the records and the factum of the Petitioner's appointment, can Respondent No. 3 conclude whether the Petitioner was appointed on a 100% grant-in-aid post in a 100% grant-in-aid institution on a permanent basis, prior to 31.10.2005.

In view of the above observations, this Petition is disposed off with a direction to Respondent No. 3 to consider and decide the Petitioner's representation dated 10.02.2025, taking into account the above decisive factors while assessing the Petitioner's claim. So also, the law laid down by the Full Bench of this Court in Deshmukh Dilipkumar Bhagwan & Ors. v. State of Maharashtra, (2019) 3 Mah.
