Present writ petition takes exception to the order dated 2.4.2025 passed by the learned Principal District Judge, Latur in Misc. Civil Appeal No.1 of 2020 whereby order dated 21.12.2019 passed below Exhibit-5 by the learned Civil Judge J.D., Latur granting temporary injunction in favour of the petitioner/plaintiff has been set aside.

This Court vide order dated 17.7.2025 directed parties to maintain status-quo observing that injunction was operating under order of the trial court till decision of appeal. Aforesaid arrangement is still continued. Learned advocate appearing for respective parties are ad-idem that meanwhile suit proceeded and recording of the evidence is started.

In view of aforesaid development, instead of delving into merits of contentions of parties, it would be appropriate that the suit is expeditiously decided and status-quo granted by this Court remains in force till disposal of the suit. Hence, writ petition stands disposed off with directions to the Trial Court to expeditiously decide the suit and in any case within a period of six months from today. Till final decision of suit, interim order granted by this Court dated 17.7.2025 shall govern the parties. 4.

Needless to state that Trial Court shall not be prejudiced by this arrangement and decide the suit on its own merits on the basis of the evidence led before it.
