Heard learned Advocate Shri.Kulkarni for the Petitioner and learned Advocate for the Respondent-husband.

This matter is coming for the first time. Learned Advocate for the Respondent waives notice. He received papers. 3.

The order of the Family Court dated 16 th June 2025 is challenged. The Petitioner-wife is given vacation access only for a 1/3

period from st June 2025 till 27 th June 2025 . The Petitioner-wife is not happy with this arrangement and that is why, present Writ Petition. As per the said order, the Petitioner-wife got custody of the daughter and she is supposed to handover the custody to the Respondent after th June 2025 at 5.00 p.m . That is why, urgent mentioning is made.

According to Mr.Kulkarni, his client is entitled to a weekend access as per the order dated 16 th January 2024 passed by the Division Bench on consent. That is why, a request to continue the custody till 5.00 p.m. of 29th June 2025.

It is submitted on behalf of the Respondent-husband that he is working in Qatar Airways at Qatar and he has planned his schedule and he is about to come to India today and he will there till Sunday. That is why, a request is made to handover the custody to him at least on Sunday morning.

Ultimately, the Court has to balance the rights of the parties. By consent, following order is passed:-

O R D E R

(i) Let the custody of the daughter be continued with the Petitioner-wife till 3.00 p.m. of 29 th June 2025 .

(ii) The custody be handed over to the Respondent-husband at 3.00 p.m. at the house of the Respondent.

(iii) The Respondent, if want can file reply to this Writ Petition. (iv) Stand over to 4th July 2025.
