The learned counsel for the respondents raises preliminary objections about the maintainability of the petition as the challenge involves the application below Order VII Rule 11 of C.P.C.. When confronted with the same, the learned counsel for the petitioner fairly concede the position that the petition would not be maintainable. In that view of the matter, the petition is allowed to be withdrawn, however with liberty to take out the appropriate proceedings as available in law.
