The Petitioner has already filed a civil suit with regard to a part of the property bearing Regular Civil Suit No. 287 of 2022. By an order below Exhibit-5, the Petitioner has been protected. 2.

In the vicinity, according to the Petitioner, there is a further encroachment. If the Petitioner is aggrieved, he can either seek an amendment and add the cause of action or prefer a separate civil suit, and seek necessary orders.

The learned Advocate for the Petitioner submits, on instructions, that he would avail of a remedy, of approaching the Civil Court.

In view of the above, this Writ Petition is disposed off as withdrawn, on instructions. Needless to state, all the contentions of the parties are kept open, and the withdrawal of this Petition would not be an impediment.
