Heard the learned Counsel for the parties.

The challenge in this Petition is to an order dated 27 June 2025 passed by the Inquiry Officer in the Departmental Inquiry against the Petitioner, thereby declining to set aside the no cross order dated 10 June 2025. On that day, the Petitioner has applied for an adjournment as S.V.Abhang, Advocate, who was to cross-examine the witness on behalf of the Petitioner, was extremely unwell and suffering from high fever and severe throat infection. 3.
Without delving into the conduct of the Petitioner, which weighed with the Inquiry Officer to refuse the prayer of adjournment and also reject the application to set aside the no cross order and the maintainability of the Petition, having regard to the nature of the impugned order and the statement made on behalf of the Petitioner that the Petitioner would cross-examine the Department's witness No.1 in two sessions, i.e., on 9th and 10th July 2025 and SSP 1/2
36 wo 9056 of 2025.doc to advance the cause of substantive justice, the impugned order stands quashed and set aside.

No cross order stands set aside, subject to the Petitioner cooperating with the Inquiry Officer in the expeditious conclusion of the departmental inquiry and conducting cross-examination of Department's Witness No.1 on 9th and 10th July 2025.

It is hereby made clear that the Petitioner shall not be granted more than two sessions to conclude the cross-examination of Department's Witness No.1.

The Writ Petition stands disposed.
