CORAM : MANISH PITALE AND Y. G. KHOBRAGADE, JJ.

DATE : 04.09.2025 PER COURT :

1.

In the order dated 18.08.2025, we had recorded as follows:- "1.

Considering the contentions raised on behalf of the petitioner, it would be appropriate that an affidavit is filed on behalf of respondent Nos.3 and 4, inter alia, clarifying whether the software utilised for deciding the transfers of employees provides an opportunity to make corrections in the form filled by the employee and, if so, setting out the details of such opportunity available under the software program.

2.

This is in the backdrop of the fact that the form filled by the petitioner himself shows that the column pertaining to whether the Jhs/ 1/2

926 WP NO. 9101 OF 2025 petitioner was suspended has been answered in the affirmative, while the petitioner claims that he was never suspended. 3.

The affidavit shall be filed within two weeks from today. 4.

List the petition for further consideration on 04.09.2025, in urgent orders category."

2.

The learned counsel appearing for respondent Nos. 3 and 4 makes a submission that the petitioner was indeed suspended on one occasion and that such a document can be placed on record. This aspect goes to the very root of the matter. Hence, respondent Nos. 3 and 4 are granted time of one week to file reply affidavit along with appropriate documents.

3.

List this petition for further consideration on 19.09.2025, in the 'urgent orders' category.
