The learned Advocate for the Corporation submits that there are many disputed issues with regard to the remaining structure on the writ land. A Regular Civil Suit No. 27 of 2011 is pending before the Civil Court, which fact is disclosed by the Petitioner. Gitalaxmi

Respondent No. 11 Mr. Sachin Mandlik has appeared in the Court in-person and he submits that the Petitioner has fraudulently obtained an Agreement to Sell of the writ property, from a deceased person. It is his residential house.

In view of the seriously disputed issues between two private individuals, touching the aspect of the right and title to the property, we do not find that this issue could be resolved by the Municipal Corporation. This matter will have to be dealt with by the learned Civil Court and the rights of the parties will have to be crystallised. 5.

The learned Advocate for the Petitioner submits that he desires to withdraw this Petition, on instructions.

In view of the above, this Petition is disposed off as withdrawn, on instructions.
