Mr. Ojha, learned Counsel appearing for the Respondents, submits that the Petitioner has illegally constructed fencing on the railway land, which has already been demolished. The Petitioner does not have any right to occupy railway land. 2.
Though the above assertions have been disputed by Mr. Garad, learned Counsel appearing for the Petitioner, yet, after arguing the matter for some time, he seeks leave of this Court to withdraw the Writ Petition in order to avail appropriate alternative legal remedy, as may be permissible under the law. 3.
Without expressing any opinion on the merits of the contention, we permit the Petitioner to withdraw the Writ Petition, with liberty as prayed for.
