Learned Counsel for the Petitioners, on instructions, seeks leave to withdraw the Petition.

Writ Petition stands dismissed as withdrawn.

Learned Counsel for the Petitioners submits that, the application for temporary injunction preferred by the Petitioners awaits adjudication before the learned Civil Judge, Sr. Division, Thane. 6.

Having regard to the issue raised by the Petitioners, it may be expedient in the interest of justice that, the application for temporary injunction is decided expeditiously.

The Court is informed that the suit is listed before the learned Civil SSP 1/2

The Petitioners shall carry out necessary amendment in the plaint in accordance with the impugned order and serve the amended copy of the plaint on the Respondent No.1 on or before 4 October 2025. 9.

The parties shall appear before the learned Civil Judge, Sr. Division, Thane, on 4 October, 2025.

Respondent No.1 shall be at liberty to file an affidavit in reply to the application for temporary injunction within a period of four weeks thereafter. 11.

The learned Civil Judge, Sr. Division, Thane, is requested to make an endeavour to hear and decide the application for temporary injunction as expeditiously as possible and preferably within a period of six months thereafter.
