CIVIL APPELLATE JURISDICTION WRIT PETITION NO.9404 OF 2025 Supriya D/o. Gajanan Koli ....Petitioner
Versus
The State of Maharashtra and Ors.
....Respondents ---- Mr. Danish Patel i/b. Ms. Vaishali Suryawanshi Birajdar for the Petitioner.

Ms. Rupali Andhare, Law Assistant present.
---- CORAM : RAVINDRA V. GHUGE & GAUTAM A. ANKHAD, JJ.
DATE : 10th JULY, 2025 P.C. :- 1.
This is a case which brings out peculiar facts. The Petitioner is a 19 year old girl student. She is a special person with certain physical challenges. Last year, she secured admission to a professional course in the faculty of Engineering at Walchand College of Engineering, Sangli. Since she did not have a "Koli Mahadev" Scheduled Tribe validity certificate and as her validity proposal was pending, her admission got cancelled. This year, she appeared for the Common Entrance Test (CET) for the Engineering faculty and secured marks sufficient to obtain admission to the professional course. Now the obstacle is that her proposal was
closed for judgment on 5th June, 2025 (erroneously mentioned as "5th May, 2025" in the memo of the Petition), but, the judgment is yet to be delivered by the competent Committee. 2.
The learned Advocate for the Petitioner submits that the Petitioner is under great stress. Last year, her admission, which was secured, was cancelled due to the proposal being pending. If the Committee does not decide her claim this time, she may once again lose her admission to the Engineering course. 3.
The learned AGP submits, on instructions from Ms. Rupali Andhare, Law Assistant, who is present in the Court hall, that one of the Members of the Committee, namely Smt. Shubhangi Kamble, has been on leave since 12th June 2025, as her one year old son suffered a fracture. The Committee comprises of three Members. Her leave was to end on 18th July, 2025 and she was to resume duties on 21st July, 2025. Since the Petitioner is likely to suffer an irreparable harm, Smt. Kamble has decided to report for duties today and by tomorrow evening, i.e., 11th July, 2025, the Committee would deliver an order in the case of the Petitioner, since
the matter is already heard and closed for judgment. 4.
We offer compliments to the learned AGP Mrs. P.N. Diwan and Ms. Rupali Andhare, for taking the initiative in this matter and we also compliment Smt. Kamble for having risen to the call for duty by cutting short her leave and reporting for duty today and for assuring the Court that a reasoned order, after considering the entire material before the Committee, will be delivered by 5:00 p.m. tomorrow.
5.
We request the Committee to ensure that its order should be transmitted to the Petitioner by midnight of 11th July 2025, on her email address as recorded below, in order to enable her to participate in the admission process commencing on 12th July 2025 :

In view of the above, this Petition is disposed off. (GAUTAM A. ANKHAD, J.) (RAVINDRA V. GHUGE, J.)
