The Petitioner was pursuing the course of Master in Physio Therapy with Respondent No. 5 Institution, which is affiliated to the Respondent No. 6 University. It was a 4 years' course. The Petitioner failed 5 times in the 2nd Year and passed the 2nd Year in the 6th attempt.

The learned Advocate for the College refers to paragraph nos. 12 & 14 of the Circular with regard to Guidelines and Rules for procedure for application submission (displayed on the website of MahaDBT), to support his contention, that as the
Petitioner has failed in one year of his course, he would not be entitled for reimbursement of the fees by the government for the remaining course.

The Petitioner is a beneficiary of the 'VJNT Post Matric Freeship' scheme, as is the contention of the Petitioner. The learned Advocate for the Petitioner submits that he would research and place on record those Government Resolutions, on the basis of which the Petitioner was entitled for reimbursement of the fees in a professional course since he belonged to the VJNT Category. He is not aware as to whether he falls in which sub-category (A to D). 4.
The learned Additional Government Pleader submits that he would call upon Respondent No. 2 to file an appropriate Affidavit in order to deal with the contentions of Petitioner and whether he would be legally entitled to the continuance of the freeship despite having failed 5 times in the 2nd Year. 5.
Let the State enter an Affidavit-in-Reply as early as possible and preferably on or before 25th September, 2025. Similarly, Respondent No. 5 Institution would also file its Affidavit.

List this Petition on 30th September, 2025 in the Supplementary Board.
