Learned counsel for the petitioner seeks leave to withdraw this petition with liberty to file appropriate application in the substantive suit filed by him, i.e. Regular Civil Suit No.64 of 2022.

Leave granted. The petitioner is at liberty to file appropriate application in Regular Civil Suit No.64 of 2022 for seeking appropriate relief of injunction as prayed in the present case.

The rival contentions of the parties on merits, including maintainability of the application are kept open. 5.

If such an application is filed, the same shall be decided on its own merits in accordance with law, uninfluenced by the orders impugned in this petition. 6.

The writ petition is disposed of with liberty as recorded above.

7.

It is clarified that ad-interim protection operating in this writ petition stands vacated.
