We have heard the learned counsel for the parties. The only prayer as made in the Petition reads thus: a) This Hon'ble Court may be pleased to issue a writ of Mandamus or writ in nature of Mandamus or any other appropriate writ or order or direction under Articles 226 of Constitution of India directing the Respondent to decide the Complaint dated 09-10-2024 made by the Petitioner as per the provisions of The Maharashtra Regional Town Planning Act, 1966.
Although, the Respondent is not represented, considering the nature of the order we intend to pass, no prejudice whatsoever be caused to the Respondent as we are inclined to dispose of this petition by directing the Respondent to decide the Petitioner's representation /complaint dated 9th October 2024, Exhibit E to the Petition, in regard to the unauthorised construction and action be taken in regard to such construction. Let the Petitioner be granted a hearing and then order on the representation / complaint be passed in accordance with law. Petitioner is Meera Jadhav
2/2 302-wp-9598-25.doc directed to appear before the Chief officer on Monday 11th August 2025 at 3.00 p.m. Thereafter, when the Petitioner be granted a hearing, an appropriate decision be taken on petitioner's representation in accordance with law. All contentions of the parties in that regard are expressly kept open. Needless to observe that taking a decision on the other parties, who are likely to be prejudiced / affected, shall also be heard in taking any such decision. All contentions of such parties are also expressly kept open. Petition is disposed of. No costs.
