IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 912 WRIT PETITION NO. 10037 OF 2025 Khandu Aaba Tambe And Others
VERSUS
The State Of Maharashtra Through Its Secretary And Others ......
Mr. Chandrakant K. Shinde, Advocate for Petitioners Mr. Abhijit M. Phule, AGP for Respondents No.1 to 3 ......
CORAM : SMT. VIBHA KANKANWADI AND HITEN S. VENEGAVKAR, JJ.
DATE : 19 DECEMBER, 2025 PER COURT :- 1.
Learned AGP is producing document exhibit 'X' to show that the award amount has been paid together with interest to the petitioners in the year 2020. He also gives a letter addressed by respondent - Deputy Collector stating that the calculation will be made in respect of rental compensation as well as under Section 80 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act. For that purpose, time of two months has been sought. In fact, it is the consistent view of this Court that such amount should be paid as early as possible. Even in this case, the payment of amount of compensation as per award is belated, and therefore, we grant time till 17.01.2026 for the respondents to calculate the amount to be paid to the petitioners. Affidavit to that effect to be filed on or before 17.01.2026.
912-WP-10037-25.odt {2} 2.
We grant liberty to the petitioners also to place their own calculations on or before 17.01.2026.
3.
Place the matter for further consideration on 22.01.2026. [ HITEN S. VENEGAVKAR ] [ SMT. VIBHA KANKANWADI ] JUDGE JUDGE S P Rane
