IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD 903 WRIT PETITION NO. 10037 OF 2025 Khandu Aaba Tambe & others ....Petitioners

VERSUS

The State of Maharashtra & others .....Respondents Mr. C. K. Shinde, Advocate for the Petitioners. Mr. A. M. Phule, AGP for the State.

Mr. P. D. Suryawanshi, Advocate for Respondent No. 4. CORAM : SMT VIBHA KANKANWADI & HITEN S VENEGAVKAR, JJ.

DATE : 13th MARCH, 2026.

PER COURT :

1.

Heard.

2.

Pursuant to the order dated 27.01.2026, the matter was for compliance. Respondent No. 3 was directed to calculate the rental compensation amount to be paid to the Petitioners after hearing all the necessary parties and the amount so calculated to be paid to the Petitioners within a period of one month from the date of determination of rental compensation.

3.

Now, it appears that there were communications between the Respondents. The land was acquired for the purpose of Respondent

- 2 - No. 4 and the learned AGP submits that after the order was passed, the determination of the amount was done and a communication was made to Respondent No. 4 to make available the funds. It appears that belatedly, on behalf of Respondent No. 4, the steps have been taken for demand of amount. We would impress upon the fact that we are not concerned with the fact that for whose purpose the land was taken and how and under which head the amount would be made available. The law gives constitutional rights to the Petitioners to receive fair compensation and therefore, it is not only the responsibility of the acquiring body but also the competent authority to see that reasonable and fair compensation is paid to the Petitioners or the persons whose land/lands are acquired.

We have therefore, directed in the morning session that the Chief Executive Officer, Zilla Parishad, Beed, to remain present. Accordingly, Mr. Jatin Rehman, Chief Executive Officer, Zilla Parishad, Beed is present and upon his instructions, Respondent No. 4 is now making a statement that the cheque would be deposited with this Court on or before 30.03.2026. We take the said statement as an undertaking. 4.

Place the matter for further compliance on 02.04.2026. We make it clear that the said duration will not be extended on any

- 3 - count but the determined amount should be deposited with this Court on or before 30.03.2026.
