Heard learned counsel for the petitioner and learned AGP. 2.
In the decree of Specific performance passed by the Civil Court, there is a direction to obtain the permission from the concerned authority and the petitioner has filed Execution Application. The Judgment Debtors have not executed the decree and that is why the Court Commissioner has been appointed to obtain the permission. Learned Collector, Nashik has informed vide letter dated 25th November, 2019 that the permission cannot be granted. Whereas it is the contention on behalf of the petitioner that permission is not required. Affidavit-in-Reply filed on behalf of Respondent Nos.1 and 2 taken on record.
