Heard Learned Counsel for the parties.

It is the submission of Learned Counsel for the Petitioner that there is fundamental error in issuing Section 13(2) Notice, which according to the Petitioner, was never served upon the Petitioner. According to Learned Counsel for the Petitioner, this is a sufficient cause for the Petitioner to maintain the Petition in this Court.

Learned Counsel for the Respondent-Bank submits that the Petitioner has efficacious remedy to approach the DRAT or the appropriate forum under the SARFAESI Act against the action, which is impugned in this Petition.
