The Petition is accordingly disposed of as withdrawn with liberty as prayed. The District Judge -2 and Addl. Sessions Judge, Pune shall decide the said Application on its own merits uninfluenced by the withdrawal of this Petition. We make it clear that we have not gone into the merits of the petition.
