Learned Counsel for the Petitioner submits that the Maharashtra State Cooperative Appellate Court, Mumbai, Bench Aurangabad had rejected the Application (Exhibit 5) without hearing the Appellant by passing order dated 4th March, 2025. An Application was moved vide Exhibit 16 to recall the said order. 3.

Perusal of the order impugned indicates that though specific grievance was made by the Petitioner/Appellate about the Advocate for the Appellant not being heard, the said grievance has not been addressed by the Appellate Court. Hence, issue notice to the Respondents, returnable on 3rd October, 2025, in 'urgent' category. 17 WP 10211.2025.odt

The Petitioner is at liberty to serve the respondents by way of legally permissible mode of service apart from the Court service and to place on record service affidavit before the next date. 5.
