IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 10300 OF 2025 Aarti Mahesh Barman

...Petitioner

Versus

State of Maharashtra and Anr.

...Respondents

Mr. Sandeep D. Sherkhane, for the Petitioner. Mr. Abhijeet Naik, AGP, for the Respondent No.1-State.

CORAM:

SUMAN SHYAM & MANJUSHA DESHPANDE, JJ.

DATED:

3rd OCTOBER, 2025.

PC:- 1.

Mr. Sherkhane, learned Counsel appearing for the Petitioner, submits that in terms of the order dated 10th September, 2025, the Bank has infact forwarded a fresh proposal for repayment of the loan but the terms are so onerous that it will not be possible for the petitioner to comply with the same.

2.

It is also the submission of the Petitioner's Counsel that along with the loan amount and interest, the Bank has also included the legal expenditure and other cost components in the final amount payable by the Petitioner, thus, imposing heavy burden upon her, in a manner which is not permissible in the eyes of the law.

52-WP-10300-2025.DOC 3.

Mr. Naik, learned AGP is present for the Respondent No.1State. However, none has appeared for the Respondent No.2 so as to address the Court on the above aspects of the matter. 4.

In view of the above, we postpone further consideration of the matter till 12th November, 2025.

5.

Interim order, granted earlier, to continue till the next date. 6.

We, however, make it clear that pendency of this Writ Petition will not be a bar for the Bank to accept a fresh schedule of repayment of the loan amount by working out a softer instalment scheme payable by the Petitioner, if so advised. (MANJUSHA DESHPANDE, J.) (SUMAN SHYAM, J.) { 3rd October, 2025
