The learned Additional Government Pleader submits that since the Petitioner has a Scheduled Caste (SC) Certificate from West Bengal, which is his native place and having travelled to Maharashtra for service purposes around 19 years ago, the Petitioner will first have to move an application for seeking a migration certificate. After due verification, if there is no legal impediment, a migration certificate would be issued. Thereafter, his son can seek issuance of the Scheduled Talwalkar

919.WP10397.2025.odt Caste certificate in the light of Rule 6(1)(a) of the Maharashtra Scheduled Castes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes, & Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Rules, 2012. 2.

We find from Rule 6 and the circular dated 22/2/2018 issued by the Ministry of Social Justice and Empowerment, Department of Social Justice & Empowerment (Scheduled Caste Development Division- Revision of Lists Cell), Government of India, that the Petitioner can seek a migration certificate and simultaneously his son can seek issuance of a caste certificate.

In view of the above, we permit the Petitioner to follow the aforesaid course. Let such application for the father and the son be filed by following the due procedure within 15 days. After due scrutiny, appropriate certificates may be issued by the Competent Authority within a further period of 15 days.
