He submits that the impugned order would therefore be appealable. He seeks leave to withdraw this writ petition with liberty to file appeal. Leave granted with liberty as prayed. 3.

Writ Petition is disposed of as withdrawn with liberty to file appeal.

It is clarified that petitioner would be entitled to seek benefit of the period of pendency of this petition for seeking condonation of delay in filing the appeal.
