At the outset, when the learned counsel for the Petitioners was confronted with prayer clause (a), i.e., whether such a prayer could be sought for or even granted, learned counsel for the Petitioners tendered an apology for drafting the said prayer. Learned counsel for the Petitioners states that he himself will deposit costs of Rs.10,000/- with the Bar Council of Maharashtra & Goa within one week from today, for making an incorrect and frivolous prayer, which is clearly is not maintainable.

Learned counsel appearing for the Respondent Nos. 1 and 2, i.e., Mumbai Metropolitan Region Development Authority (MMRDA) makes a statement that due procedure of law will be followed by the said Respondents before taking any step/action against the Petitioners' structures. Statement accepted. 5.

In view of the aforesaid, nothing survives for further consideration in the present Petition.
