Heard the learned Counsel for the Petitioner. 2.

In the case of Jagdish Pitamber Pawar V/s. Pitamber Pundalik Pawar and Ors.1, this Court has held that the appeal under Section 16 of the Act, is maintainable even at the instance of any of the children or relatives of the senior citizen.

Mr. Sharma, learned Counsel for the Petitioner, seeks leave to withdraw the Petition with liberty to file an appeal under Section 16 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 before the appellate authority.

Mr. Sharma, however, submits that since the period of 30 days is expiring on 2 August 2025, the Petitioner be granted limited protection so as to prefer an appeal and seek interim orders from the appellate authority. 5.

Leave granted with liberty as prayed for.

The Petitioner is permitted to file an appeal before the appellate authority within a period of two weeks.

To facilitate the Petitioner to file an appeal and seek interim orders from the appellate authority, the execution and operation of the order dated 16 May 2024 passed by the Tribunal is stayed for a period of two weeks. 8.
