Mr. Sankpal has drawn my attention to the impugned order appended at Exhibit-E, page No.50 which is an interlocutory order passed in application filed below Exhibit 'C-2' seeking stay of effect, execution and operation of Award in Reference IDA No.50 of 2021 which came to be decided on 08.08.2022.

According to him Miscellaneous Application (IDA) No.13 of 2023 has been filed for setting aside the ex parte Award and restoration of original IDA for a fresh hearing. He would submit that since Award dated 08.08.2022 was passed ex parte, as also on various grounds which are stated in the Petition, without delineating into the
905.WP.10540.2025.doc merits of matter or giving any imprimatur of this Court, interest of justice would be sub-served if appropriate directions are given to the learned Labour Court seized with hearing of Miscellaneous Application (IDA) No.13 of 2023 to determine the same as expeditiously as possible and within a time bound programme.

In view of the above, learned Labour Court seized with hearing of Miscellaneous Application (IDA) No.13 of 2023 shall decide the same after hearing both the sides and strictly in accordance with law within a period of four weeks from today. 5.
Needless to state that in that view of the matter, no coercive steps whatsoever shall be taken against the Petitioner in furtherance of the impugned order i.e. rejection of stay which has been granted by the impugned order until Miscellaneous Application (IDA) No.13 of 2023 is decided as directed hereinabove.

All contentions of both the parties are expressly kept open. 7.
With the above directions, Writ Petition is allowed and disposed.
