The present Writ Petition takes exception to the order dated 7th May 2023 passed by Sub-Divisional Officer, Miraj in Revision Application No.366 of 2023, thereby upholding order passed by learned Tahsildar in Land Case No. 18 of 2018, whereby Tahsildar allowed an Application under Section 5 (2) of Mamlatdars' Courts Act, 1906.

The learned Advocate fairly points out that Petitioners have already filed substantive suit i.e. Regular Civil Suit No.398 of 2023, which is pending before learned Civil Judge Senior Division, Sangli seeking declaration against order impugned in this Writ Petition.

In that view of matter, Writ Petition stands disposed of with liberty in favour of Petitioners to raise all contentions taken in this Writ Petition, before Civil Court in pending suit, which shall be considered on its merits.
