Heard learned counsel for the petitioner.

It is brought to our notice that the son and daughter of the petitioner have been granted conditional validity certificates by this Court by order dated 11.08.2025 passed in Writ Petition No.10052/2025. The impugned order was a common order deciding the tribe claims of the petitioner herein as well as his son and daughter.

It is further brought to our notice that two more paternal relatives of the petitioner were granted conditional validity certificates by order dated 07.08.2023 passed in Writ Petition No.9453/2023. It is a matter of record that as many as eight other paternal side relatives have been granted validity certificates by the Scrutiny Committee. It is also a matter of record that in the impugned order the Scrutiny Committee has found it fit to issue notices to the validity holders for reopening their cases.

Issue notice, returnable on 14.10.2025. Learned AGP waives notice on behalf of the respondent Nos.1 and 2. 5.
Since the petitioner is in service, limited interim relief can be granted.

Accordingly, it is directed that during the pendency of this petition, the service of the petitioner shall not be terminated only on the basis of the impugned order passed by the respondent No.2 - Scrutiny Committee, subject to the petitioner filing an undertaking within two weeks from today stating that he shall not claim any service benefit during the pendency of this petition such as promotion, increment, pay fixation, etc. Copy of such undertaking shall also be placed before the respondent No.3 within the aforesaid period of two weeks.
