The grievance of the Petitioners is that though the Management has forwarded the proposal with reference to the Petitioner employees, for granting Shalarth ID in the light of their approvals granted by the Competent Authority, the same are pending with Respondent No. 2. Reliance is placed on the Judgment delivered by this Court in Writ Petition No. 10133 of 2016 dated 01.08.2016 (Shivanne Prasanna Deshpande v/s. State of Maharashtra & Ors.), wherein this Talwalkar

914.WP10704.2025.odt Court has concluded that if the approval is intact, the same cannot be interfered with unless a grave and serious issues of fraud is brought to the notice of the Authority.

In catena of Judgments, this Court has concluded that when approval is intact, Shalarth ID has to be granted. Reliance is placed on the following Judgments:

(i) Dilip Mohan Desai v/s. The State of Maharashtra & Ors. (Writ Petition No. 2503 of 2020 decided on 16th December, 2020). (ii) Amol Baban Sangar v/s. The State of Maharashtra & Ors. (Writ Petition No. 8966 of 2021 decided on 21st February, 2022). 3.

In view of the above, we direct Respondent No. 2 to consider above stated judicial pronouncements and pass a reasoned order of granting Shalarth ID to these Petitioners, keeping in view that their approvals are intact.
