Heard learned counsel for the petitioner.

The petitioners are aggrieved by the impugned transfer order dated 22.08.2025. The principal grievance of the petitioner is that the this is a mid term transfer as the transfer policy manifested in the Government Resolution dated 18.06.2024 at clause 5.6 mandates that ordinarily Zilla Parishad employees like the petitioner herein, shall be transferred only once in a year between 01-May to 31-May. It is submitted that there is no reason recorded in the impugned transfer order justifying such mid term transfer. It is contended that the petitioner has already arranged her affairs in the form of admissions of children and therefore, this mid term transfer is clearly unjustified.

Additionally, in this petition, the petitioner claims that her husband has undergone heart surgery and therefore, she was entitled to benefit of clause 1.8.15 of the Government Resolution dated 18.06.2024. She had accordingly filled her form in category 'I' as per special category teacher under Clause 1.8. The said form was arbitrarily rejected and therefore, the petitioner is likely to suffer injustice.

Issue notice, returnable on 03.10.2025. The learned AGP waives notice on behalf of respondent Nos. 1 and 2. 5.

The petitioner is permitted to serve other respondents by way of private service and to file affidavit of service before the next date of listing.

In the meanwhile and till the next date of listing, status quo as on today, shall be maintained.
